PROHIBITED PRACTICES OF CLEARVIEW AI, INC.

REGARDING ONLINE FACE RECOGNITION

Identification through biometric data is important in a digital environment. The problem arises when such data is used for monitoring and profiling without the knowledge and consent of users by representatives of the private sector. To clarify this issue, an assessment of the legal aspects is proposed, using Clearview AI, Inc. as an example. The results obtained are important for understanding the practical application of the relevant prohibition and legal consequences in the context of the GDPR regarding the lawfulness of processing biometric data without a legal basis.

Keywords: personal data, unique identification, biometric data processing, General Data Protection Regulation (GDPR).
