ОСОБЛИВОСТІ КВАЛІФІКАЦІЇ ОКРЕМИХ ЗЛОЧИНІВ ПРОТИ ЗДОРОВ’Я ОСОБИ

Ця стаття присвячена проблемам кваліфікації окремих злочинів проти здоров’я особи, що передбачені розділом ІІ Особливої частини Кримінального кодексу України. На практиці не завжди враховується положення теорії кримінального права та правил кваліфікації, а положення підзаконних нормативно-правових актів є застарілими. Тому проаналізовано критерії розмежування деяких злочинів проти здоров’я особи. Встановлено їх окремі об’єктивні та суб’єктивні ознаки, що виступають розмежувальними ознаками.

Ключові слова: здоров’я особи, злочин, шкода здоров’ю, тілесні ушкодження.
