НА ВІСТРІ УВАГИ: КВАЛІФІКАЦІЯ ЗА СУКУПНІСТЮ СТ. 111 «ДЕРЖАВНА ЗРАДА» І ЧАСТИН 2, 5 АБО 7 СТ. 111-1 «КОЛАБОРАЦІЙНА ДІЯЛЬНІСТЬ» КРИМІНАЛЬНОГО КОДЕКСУ УКРАЇНИ

         У статті доведено, що добровільне зайняття громадянином України посади, не пов’язаної з виконанням організаційно-розпорядчих або адміністративно-госпо­дарських функцій, у незаконних органах влади, створених на тимчасово окупо­ваній території, у тому числі в окупаційній адміністрації держави-агресорки (ч. 2 ст. 111- 1 КК) або посади, пов’язаної з виконанням таких функцій (ч. 5 ст. 111-1 КК), або посади в незаконних судових або правоохоронних органах, створених на тим­часово окупованій території (ч. 7 ст. 111-1 КК), та подальше здійснення ним своєї професійної функції на цих посадах потребує кваліфікації за сукупністю ч. 2 ст. 111 і частин 2, 5 або 7 ст. 111-1 КК. Такий умовивід обґрунтовано результатами тлума­чення норм про державну зраду та колабораційну діяльність у зазначених формах і визначенням співвідношення між відповідними складами злочинів. Зроблено висновок про наявність конкуренції між державною зрадою у формі переходу на бік ворога в умовах воєнного стану та добровільним зайняттям відповідних посад як загальної і спеціальної норм і неохоплення вказаними формами, що потребує кваліфікації за сукупністю з ч. 2 ст. 111 КК здійснення професійної функції на таких посадах.
