КОМПЕТЕНТНІСТЬ СУДДІ –ГАРАНТІЯ ДОСТУПУ

ДО ПРАВОСУДДЯ У СПРАВАХ ПРО ВОЄННІ ЗЛОЧИНИ

У статті досліджується компетентність судді крізь призму гарантування доступу до правосуддя у справах про воєнні злочини. На основі узагальнення рекомендацій за результатами оцінки потреб суддів, моніторингу судових процесів і досвіду проведення навчальних заходів у межах підготовки та підвищення кваліфікації суддів виявлено спеціальні знання, уміння та навички, необхідні для розгляду справ щодо воєнних злочинів, для розгляду кримінальних проваджень за ст. 438 КК України, виокремлено експертну, методичну та соціальну компетентність судді та наведено конкретні їх прояви у цій категорії справ.

Ключові слова: доступ до правосуддя, верховенство права, воєнні злочини, компетентність судді, суд.
