ПРАКТИЧНІ АСПЕКТИ ВІДШКОДУВАННЯ ШКОДИ, ЗАВДАНОЇ ГРОМАДЯНИНОВІ НЕЗАКОННИМ ПРИТЯГНЕННЯМ ДО КРИМІНАЛЬНОЇ ВІДПОВІДАЛЬНОСТІ

У статті досліджуються практичні аспекти відшкодування шкоди, завданої незаконним притягненням до кримінальної відповідальності. Проаналізовано положення цивільного законодавства України, проблеми оцінки моральної шкоди, відсутність критеріїв визначення її розміру та недосконалість судової практики. Особливу увагу приділено практиці ЄСПЛ і міжнародним стандартам. Наведено статистику виправдувальних вироків і рекомендації для вдосконалення механізмів відшкодування.

Ключові слова: відшкодування шкоди, незаконне притягнення до кримінальної відповідальності, моральна шкода, матеріальна шкода, кримінальне провадження, арешт, повідомлення про підозру.
