The next issue “Slovo of the National School of Judges of Ukraine” was released

The next issue of the professional national scientific, practical and methodological legal publication "Slovo of the National School of Judges of Ukraine" No 3 (44) 2023 was published.

The leading article of the edition is the article Nataliya Antonyuk Deputy Head of Criminal Cassation Court  within the Supreme Court, judge, PhD in Law, Associate Professor  and Zoia Zahynei-Zabolotenko, Head of the Analytical and Legal Work Division of the Criminal Court of Cassation of the Department of Analytical Assistance to the Courts of Cassation and the Grand Chamber of the Supreme Court of the Department of Analytical and Legal Work of the Supreme Court, Doctor of Law, Professor "In the spotlight: qualification under the combination of Article 111 "High Treason" and Parts 2, 5 or 7 of Article 111-1 "Collaboration Activities" of the Criminal Code of Ukraine".

The article proves that the voluntary holding by a citizen of Ukraine of a position not related to the performance of organizational and administrative or administrative and economic functions in illegal authorities established in the temporarily occupied territory, including in the occupation administration of the aggressor State (part 2 of Art. 111-1 of the CCU) or a position related to the performance of such functions (Article 111-1(5) of the CCU), or a position in illegal judicial or law enforcement bodies established in the temporarily occupied territory (Article 111-1(7) of the CCU), and the further exercise of his/her professional function in these positions requires qualification under the totality of Article 111(2) and Article 111-1(2), (5) or (7) of the CCU.

This conclusion is substantiated by the results of the interpretation of the provisions on high treason and collaboration in these forms and by determining the correlation between the respective corpus delicti. The author concludes that there is a competition between treason in the form of defection to the enemy under martial law and voluntary holding of relevant positions as a general and special norm and that these forms are not covered, which requires qualification under Part 2 of Art. 111 of the CC of the exercise of professional function in such positions.

The National School of Judges of Ukraine invites you to publish an article in the professional national professional scientific and practical legal magazine “Slovo of the National School of Judges of Ukraine” (according to the order of the Ministry of Education and Science of Ukraine № 1081 dated September 29, 2014, the journal is included in the List of scientific professional editions of Ukraine, in which the results of the dissertation works for obtaining the scientific degrees of doctor and candidate of sciences can be published).

The publication of the articles is free of charge. Also free of charge the authorial copy of edition is sent to an author.

The target audience of magazine are candidates on justiceship, judge, workers of organs of the system of justice, office of public prosecutor, advocacies, practicing lawyers, teachers and students of faculties of law of higher educational establishments and others like that.

The articles on an actual theme, containing the results of  deep scientific research of modern problems of development of legal science, legislation and practice are accepted by the Editorial Board and considered for review before publication in magazine.

The next issue of the national professional scientific and practical legal magazine “The Slovo of the National School of Judges of Ukraine” No. 4 (29) 2019 was published.

The leading article of the issue іs Vasyl Il'kov's article "The Supreme Court's Decision in the Model Case as a Court Case in the Legal System of Ukraine". The article deals with the concept and features of the Supreme Court's decision in the model case as a judicial precedent. The article examines the judicial precedent in the legal system of Ukraine, which is the Supreme Court ruling in the model case, which contains conclusions on the application of the rules of law and formulated a rule, mandatory for the use of administrative courts and authorities in resolving such issues during consideration of public law disputes.

The issue also included scientific articles under the headings "Organization of Judiciary", "Administrative Procedural Law", "Civil  Procedural Law", "Criminal Procedural Law", as well as Information and analytical report on the activity of the National School of Judges of Ukraine in 2019 and the Procedure for evaluating the effectiveness Judicial Education in the Judgment Monitoring component and news of the institution's activities.
