PROTECTION OF ONE SPOUSE'S PROPERTY FROM THE RISK OF SEIZURE WHEN APPLYING PRECAUTIONARY MEASURES AGAINST THE OTHER SPOUSE: ECHR PRACTICE AND UKRAINIAN REALITIES

 

The article is devoted to analyzing the legal nature of the seizure of property belonging to one spouse in criminal proceedings initiated against the other spouse. It examines the compliance of Ukrainian practice with ECHR standards, particularly in light of the Godlevskaya v. Russia case, and provides examples of national judicial practice. Ways to improve legislation to ensure a balance between the interests of the state and the rights of private individuals are proposed.
