ЗАХИСТ МАЙНА ОДНОГО З ПОДРУЖЖЯ ВІД РИЗИКУ АРЕШТУ ПРИ ЗАСТОСУВАННІ ЗАБЕЗПЕЧУВАЛЬНИХ ЗАХОДІВ ПРОТИ ІНШОГО

З ПОДРУЖЖЯ: ПРАКТИКА ЄСПЛ І УКРАЇНСЬКІ РЕАЛІЇ

Стаття присвячена аналізу правової природи арешту майна одного з подружжя в межах кримінального провадження, відкритого щодо іншого з подружжя. Розглянуто відповідність української практики стандартам ЄСПЛ, зокрема у світлі справи Godlevskaya v. Russia, та наведено приклади національної судової практики. Запропоновано шляхи вдосконалення законодавства для гарантування балансу між інтересами держави й правами приватних осіб.
