IMPARTIALITY OF THE COURT IN DOMESTIC VIOLENCE CASES

 

The article considers ensuring the principle of impartiality of the court in cases of domestic violence in view of the peculiarities of judicial proceedings in this category of cases. It is noted that in accordance with international legal acts, the practice of the European Court of Human Rights and the Law of Ukraine “On Prevention and Combating Domestic Violence”, the consideration of cases of this category must take place in compliance with the guarantee of fair trial. It is concluded that national legislation is not fully consistent with these provisions, which requires the introduction of relevant legislative amendments in order to increase the effectiveness of responding to cases of domestic violence.
