The third issue of the journal “Word of the National School of Judges of Ukraine” has been published

The third issue of the professional nationwide scientific-practical and scientific-methodical legal publication “Word of the National School of Judges of Ukraine” No. 3 (52) 2025 has been published.

The leading article of the issue is the publication by Doctors of Law Serhiy Prylutsky and Olga Streltsova “The Role of the Judiciary in Preventing Political Corruption: Current Experience in the Conditions of European Integration”, which focuses on the issues of political corruption, as well as its destructive impact on the independence of the judiciary. The authors of the study investigate the interdependence and mutual influence of these legal phenomena, with the key focus being on the phenomenon of a revolutionary (historical) judicial decision, which has an impact on global legal processes in the state, in particular reforms of the justice system. Researchers conclude that political corruption poses the greatest risks of destabilizing the national legal system and democratic order in the state. If at the national level the worst consequence of political corruption is the usurpation of state power, legal anarchy and the introduction of authoritarian or totalitarian regimes, then the worst consequences of international political corruption are international conflicts and wars. Overcoming the effects of corruption on the processes of organizing the judiciary is a key goal on the path to establishing an independent judiciary in the state. Just as an independent judiciary cannot exist in the conditions and under the influence of political corruption, political corruption cannot actively develop in the space of an independent judiciary. “Independent judiciary” and “political corruption” are antagonistic phenomena to each other. National and international judicial practice, through relevant “revolutionary (historical) decisions”, creates exemplary standards of the rule of law and judicial justice, which require mandatory study and application by courts and state authorities.

The issue published scientific articles under the headings: “Theory of Law and State” – Oleksandr Babarytskyi and Serhiy Ivashchenko “Cooperation of Military Administrations: Experience of Partnership in Armed Conflict”, Serhiy Sunegin “Reforming the Legislative System of Ukraine in the Context of European Integration: Current Realities and Challenges”; “Organization of Judicial Proceedings” – Svitlana Bobrovnyk “Implementation of Judicial Proceedings Principles in the Activities of the Constitutional Court of Ukraine (Theoretical and Legal Aspect)”; “Civil Law” – Olena Belyanevich “On the Moment of the Origin of a Conditional Obligation”, Igor Alekseev “Joint Liability of Russian Companies Under Russian Control for Damage Caused by Its Armed Aggression against Ukraine”; “Civil procedural law” – Oleksiy Nesterenko, Alina Ustimenko “Problematic issues in the assessment of evidence in credit disputes by the court”; “Commercial procedural law” – Olga Kvasnitskaya “Principles of proceedings in bankruptcy cases as a special form of economic proceedings”; “Family law” – Viktor Kalakura and Natalia Horbal “Protection of the property of one of the spouses from the risk of arrest when applying precautionary measures against the other spouse: the practice of the ECHR and Ukrainian realities”; “Financial law” – Vitaliy Pysmenny “Formation of the legal field of the functioning of cryptocurrencies in Ukraine”; “Criminal law” – Natalia Akhtyrska, Lyudmila Parshikova “Prevention and counteraction to human trafficking in Ukraine: new challenges of martial law and European integration obligations”; “Criminal procedural law” – Yuriy Myroshnychenko “Main trends in law enforcement and prospects for scientific research into the problems of searching a person’s home or other property”, Sergey Berezhny “Characteristics of the rules for recognizing evidence as admissible in criminal proceedings (theoretical and practical aspects)”, Marina Demura “On the issue of improving legislation on the investigation of domestic violence”, Dmitry Svoyak and Margarita Burlak “Impartiality of the court in cases of domestic violence”; “International law” – Andriy Andreykiv “International legal standards of economic cooperation during crises: features of theory and judicial practice”.
