The jubilee issue of the journal  «Slovo of the National School of Judges of Ukraine»  has been released

The new issue of the professional nationwide scientific-practical and scientific-methodical legal journal «Slovo of the National School of Judges of Ukraine» № 2 (51) 2025 has been published.

The key article of this issue is by Vasyl ILKOV, judge of the Dnipropetrovsk District Administrative Court, trainer at the National School of Judges of Ukraine, Doctor of Law, Professor, author of the article «Online mediation: international models and prospects for judgment in Ukraine». The article provides a comprehensive analysis of the prospects for implementing online mediation in Ukraine, taking into account the international experience of Canada, the United Kingdom, and the Netherlands. The author explores key examples of digital justice implementation, such as the Civil Resolution Tribunal (CRT) in British Columbia (Canada), Online Civil Money Claims (OCMC) in the United Kingdom, and the Rechtwijzer/Uitelkaar.nl platform in the Netherlands. Particular attention is paid to the legal framework, technical solutions, the role of the state, and the effectiveness of the proposed models – in particular, their ability to reduce the burden on the judiciary, increase access to justice, promote self-representation by citizens, and reduce the cost of dispute resolution. It is concluded that Ukraine has both legal and technical prerequisites for implementing similar tools.

The article offers possible adaptation mechanisms: the creation of a national online dispute resolution platform (ODR). This instrument combines the advantages of alternative dispute resolution with the technological capabilities of the Internet, enabling the parties to the conflict to resolve disputes online, without physically attending the court. In the context of global challenges, such as the Covid-19 pandemic and the full-scale war in Ukraine, such instruments are particularly relevant as they ensure continuity of access to justice even when the court system is operating at a limited capacity. In international practice, there are already real, functioning models of online mediation that are used at both the state and private levels.

The issue contains scientific articles under the following sections: «Human Rights» - Oksana Mazur «The right of access to court as an aspect of the right to a fair trial is guaranteed by Article 6 of the Convention for the Protection of Human Rights and Fundamental Freedoms»; «International Law» - Olga Brynzanska «Policy of International Criminal Court on environmental crimes at the present stage», Daria Bulgakova «Prohibited practice of Clearview AI, Inc. regarding online facial recognition of photo images», Olga Balatska «Consistency of the case law of the Court of Justice of the European Union and national courts in the context of the doctrine of the supremacy of law», Olesya Kozakevych «Legal challenges of our time: Can artificial intelligence replace a judge», Mark Belkin, Leonid Belkin  «On the question of the possibility of applying the legal institution of installments, postponement, exemption from payment of court fees or reduction of its amount to a legal entity in commercial, civil and administrative cases»; Oleksandr Sytnikov «From complaint to statement of claim: historical and legal analysis of the introduction and development of the claim form of appeal to the court in the administrative justice of Ukraine»; Oleg Pecheniy «The problems of applying the mandatory share in inheritance: dynamics of legislation and judicial practice», Yana Odovichena «Consent to the processing of personal data and the procedure for obtaining it», Valeria Bogdanova «Grounds for Exemption from Contractual Liability: A Practical Aspect»; «Civil Process» - Svitlana Fursa, Yevhen Fursa «Constructive-critical analysis of preparatory proceedings in civil proceedings»; «Financial and banking law» -  Oleg Reznik,  Alla Rubanenko «The effectiveness of financial monitoring in the context of ensuring national security of the state: concepts and basic criteria»; «Criminal law» - Zoya Zagyney-Zabolotenko «Establishing the Form of Accomplicity in the Qualification of War Crimes: Approaches in Judicial Practice (on the Example of the «Yahidnyansky case»)», Mary Krasiy «EU criminal law policy in the field of combating terrorism»; «Criminal prosedure law» - Mykhailo Gutsalyuk «Implementation of European standards in the combating against cybercrime: problems of legal regulation of electronic evidence in Ukraine», Stanislav Sheptukhovskyi «Investigative jurisdiction of plural criminal offenses».
